Welcome to Verified Vibe. These Terms of Service ("Terms") govern your use of the Verified Vibe mobile application ("App") operated by Soliton Group LLC ("Company," "we," "us," or "our").
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
To use Verified Vibe, you must:
- Be at least 18 years old
- Be legally able to enter into a binding contract
- Not be prohibited from using the App under applicable law
- Not have been previously banned from the App
- Provide accurate and truthful information
2. Your Account
2.1 Account Creation
You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your login credentials.
2.2 One Account Per Person
You may only create one account. We may terminate duplicate accounts.
2.3 Account Security
You are responsible for all activity on your account. Notify us immediately if you suspect unauthorized access.
3. How Verified Vibe Works
3.1 Verification Levels
Verified Vibe uses a two-tier verification system:
Bank Verification (Required): All users must connect a bank account through Plaid. This helps us verify your account and reduce bots and fraudulent activity.
ID Verification (Optional): You may optionally verify your identity by submitting a government-issued ID and selfie. This gives you a "Gold Verified" badge and enables photo verification (proving your profile photos show the real you).
3.2 Behavioral Verification
Verified Vibe generates user profiles based on verified behavioral data, including:
- Financial transaction patterns (via Plaid)
- Location patterns
- Screen time usage
- Career information (via LinkedIn)
3.3 Profile Generation
We use AI to analyze your behavioral data and generate profile attributes (e.g., "Fitness Enthusiast," "Frequent Traveler"). These attributes are probabilistic and based on patterns in your data.
3.4 Matching
We use your verified profile to suggest compatible matches. Matching is based on behavioral compatibility, not self-reported preferences alone.
3.5 Data Sources
You control which data sources are connected. However, financial data (via Plaid) and location data are required to use Verified Vibe's core features. If you disconnect either of these sources:
- Your account enters "dormant" mode
- You cannot match with users, play matching games, or use AI features
- This applies regardless of subscription status
Screen time and LinkedIn are optional and enhance your profile but are not required for core functionality.
3.6 Account Quality Requirements
For profile generation to work, you must connect at least one financial account you use regularly (checking or credit card). Savings accounts with occasional deposits may not provide enough activity for profile generation. Connecting multiple accounts improves profile accuracy.
4. User Conduct
4.1 You Agree To:
- Provide accurate information
- Treat other users with respect
- Use the App for its intended purpose (dating and social connection)
- Report violations and concerning behavior
4.2 You Agree NOT To:
- Harass, threaten, or abuse other users
- Create fake or misleading profiles
- Use the App for commercial purposes without permission
- Upload illegal, harmful, or offensive content
- Attempt to circumvent security measures
- Scrape, copy, or misuse data from the App
- Impersonate another person
- Use the App if you are under 18
- Use the App if you are married or in a committed relationship (unless your partner knows and consents)
4.3 Prohibited Content
You may not upload or share:
- Nudity or sexually explicit content
- Violence or graphic content
- Hate speech or discrimination
- Content involving minors
- Illegal content
- Spam or commercial solicitation
- Content you don't have rights to share
5. Content Moderation
5.1 Photo Review
All photos are reviewed for compliance with our guidelines. We use automated systems and human review to detect prohibited content.
5.2 Reporting
You can report any user, message, or content that violates these Terms. We review all reports and take appropriate action.
5.3 Enforcement
Violations may result in:
- Warning
- Temporary suspension
- Permanent ban
- Reporting to law enforcement (for illegal activity)
We reserve the right to remove content and terminate accounts at our sole discretion.
6. Messaging
6.1 Message Security
Messages are transmitted securely and stored as needed to provide messaging features.
6.2 Message Retention
Messages are retained as needed to provide messaging features and enforce safety policies.
6.3 AI Features
- AI Assistant: Our AI assistant can help you use the App and answer questions.
- In-Chat Suggestions (optional): If enabled, our AI may analyze your messages to provide conversation suggestions. This feature is disabled by default and can be enabled on a per-chat basis.
7. Subscriptions and Payments
7.1 Free and Paid Features
Some features of Verified Vibe require a paid subscription. Pricing and features are displayed in the App.
7.2 Billing
Subscriptions are billed through Apple App Store or Google Play Store. Billing terms are governed by those platforms.
7.3 Cancellation
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
7.4 Refunds
Refunds are handled according to Apple and Google's refund policies. We do not provide direct refunds.
8. Intellectual Property
8.1 Our Content
The App, including its design, features, and content, is owned by Soliton Group LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
8.2 Your Content
You retain ownership of content you upload (photos, messages). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App.
8.3 Feedback
If you provide feedback or suggestions, we may use them without obligation to you.
8.4 Copyright Policy (DMCA)
Copyright complaints should be submitted to dmca@verifiedvibe.app or via the contact form (select "Copyright/DMCA"). See our full DMCA Policy. We terminate accounts of users who are repeat infringers in appropriate circumstances.
9. Disclaimers
9.1 No Guarantees
We do not guarantee:
- That you will find a match or relationship
- The accuracy of other users' profiles
- The safety of interactions with other users
- Uninterrupted or error-free service
9.2 User Interactions
We are not responsible for the conduct of users on or off the App. Use caution when interacting with other users, especially when meeting in person.
9.3 Profile Accuracy
While we verify behavioral patterns, we cannot guarantee the accuracy or truthfulness of all profile information. Users may still misrepresent themselves.
9.4 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR THE ACTIONS OF OTHER USERS
11. Indemnification
You agree to indemnify and hold harmless Soliton Group LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person
- Content you upload or share
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal dispute, contact us. We will attempt to resolve the issue informally within 30 days.
12.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
12.4 Exceptions
The following disputes are not subject to arbitration:
- Claims in small claims court
- Intellectual property disputes
- Requests for injunctive relief
13. Termination
13.1 By You
You may delete your account at any time through the App or by submitting a request.
13.2 By Us
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination include:
- Violation of these Terms
- Fraudulent or illegal activity
- Conduct harmful to other users
- Extended inactivity
13.3 Effect of Termination
Upon termination:
- Your access to the App will end
- Your profile and data will be deleted
- These Terms will no longer apply, except for provisions that survive termination
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
15.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
15.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
15.4 Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
15.5 Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
